Together TV's Facebook Prize Draw 2022

1.         Overview
1.1         This initiative is being run by Together TV, a trading name of The Community Channel CBS (the Promoter).

1.2        Together TV is owned by The Community Channel, a charitable Community Benefit Society registered with the FCA (RS007400) and HMRC (EW58536).  

1.3        The initiative opens at 5am Friday 11th February 2022.

2.         How To Enter
2.1         Entrants must be part of our Facebook group.

2.2         Entry is free. All applicants will automatically subscribe to our newsletter.

3.         Eligibility Criteria
3.1            This initiative is only open to entrants aged 18 or over at the time of entry who reside in the UK and Channel Islands. The Promoter reserves the right to request evidence of the identity and age of any entrant.

3.2            Entries are limited to one per person.

3.3            By entering this initiative, you agree to abide by each and all of these Terms. The Promoter reserves the right, with or without cause, to exclude any party and withhold prizes for violating any of these Terms. The Promoter reserves the right to amend these Terms and any amendments to them will be published on the Promoter’s website.

3.4           Incomplete, false, or fraudulent entries or those that do not conform to all terms of the Eligibility Criteria will be invalid. 

3.5           By entering the initiative, any subsequent Winner agrees to allow the free use of their name, photographs and general locations for publicity and news purposes during this and future promotions by Promoter or any associated or subsidiary company of the Promoters.

3.6           If any person is determined to have actually or allegedly breached any of these Terms they may be disqualified. If a Winner is disqualified, the Promoters reserve the right to select a winner via the relevant judging panel.

4.         Selection Process
4.1           The winners will be randomly select from all the entrances.

4.2.    Each entry will include a picture of the entrant’s dish.

4.3.    The promoter will aim to distribute the prize from 31st March .

5.         The "Prize"
5.1       There will be 5 prizes available (the "Prize) a signed copy of Nadiya’s Bakes book.

5.2       Entrants will be successful on a first come first served basis until all prizes have been assigned.

5.3        The Prize is subject to any terms and conditions of the manufacturer, supplier and/or prize provider. By participating, entrants agree that the prize is awarded on an “as is” basis and that the Promoter makes no representations or warranties of any nature with respect to the prize. No cash or other alternative to the prize is available and it is non-exchangeable and non-transferable but in the event of unforeseen circumstances the Promoter reserves the right to substitute the prize for a similar prize of equal or greater value.

6.         General Terms 
6.1            There is no additional cash or other alternative to the prize stated and the prize is non-transferable and no part of the prize may be substituted for other benefits, items or additions. 

6.2            The Promoter will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections, which may limit or prohibit an eligible entrant's ability to participate in the inititive. Other than death or personal injury arising from the acts or omissions of Promoter, or their employees, Promoter will not be liable for any loss or damage arising out of the Winners’ enjoyment of the prize

6.3            The entrants are responsible for ensuring they are able to accept the prize in accordance with these Terms, and if they are unable to do so, the Promoters reserve the right to reselect the winner. 

6.4            At the Promoter’s sole discretion, any entry into the initiative may be used by the Promoter for promotional or marketing purposes and by entering the initiative, entrants hereby grant the Promoter an exclusive, sub-licensable worldwide licence in all copyright and other intellectual property in or arising out of their entry to the initiative, for the full duration of such rights, to use, publish, distribute, broadcast, display, make available, copy and modify the entry in all media whether existing or hereinafter devised, in particular all digital and online media, printed media, social media for such marketing and promotional purposes.

6.5            Entrants also hereby agree to irrevocably and unconditionally waive any and all moral and similar rights vesting in their entry to the initiative and to undertake to execute all such documents and do such further acts as are reasonably required by the Promoter to perfect the licence of all rights and interests referred to in these Terms and Conditions to the Promoter. Entrants hereby represent and warrant that they have all rights necessary to grant the rights provided for in this paragraph and that all materials forming part of their entry to the initiative, and any use of such materials by or on behalf of the Promoter, comply with all applicable laws, rules, and regulations and do not infringe or otherwise violate the intellectual property or other rights of any third party.

6.6            By participating in this initiative, entrants agree to be bound by these Terms and Conditions (which may be amended or varied at any time by the Promoter) and by the Promoter’s decisions, which are final in all matters relating to these Terms and Conditions, the initiative and/or the results and no correspondence or discussion shall be entered into.

6.7            Save where it has been negligent, the Promoter will not be responsible for any damage, loss or injury resulting from entrants' entry into the initiative or their acceptance and/or use of the prize. The Promoter accepts no responsibility for entries which are lost, corrupted, damaged, not received or delayed or which cannot be sent due to technical errors, network, computer hardware, system or software failures and/or interruptions of service or for any other reason. Proof of sending an email will not be accepted as proof of receipt by the Promoter. Nothing in these Terms and Conditions shall in any way limit the Promoter's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.

6.8            The Promoter accepts no responsibility for incomplete personal details provided by an entrant. Incomplete entries or those not complying with these Terms and Conditions will not be valid.

6.9            By entering this initiative, you agree to the use of your name, and photograph for publicity purposes on social media channels, websites and in any other media and you agree to appear at publicity events without any additional compensation and as required by the Promoter.

   6.10         Any participation instructions form part of these Terms and Conditions.

6.11         The Promoter reserves the right to modify, cancel, terminate or suspend the initiative in whole or in part, at its sole discretion, if it believes the initiative is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, a computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of the Promoter which could corrupt or affect the administration, security, impartiality or normal course of the initiative. The Promoter is not responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any supplier selected by the Promoter to provide the prize or otherwise that may cause the Competition to be disrupted or corrupted, or that may lead to loss or damage of the prize in transit to the winner.

6.12         These Terms and Conditions shall be governed by and construed in accordance with English law and entrants agree to irrevocably submit to the exclusive jurisdiction of the English courts in respect of any dispute arising out of or in connection with them.

6.13         The Promoter of this competition is The Community Channel, a charitable Community Benefit Society, registered with the FCA (RS007400) and HMRC (EW58536), whose business office is at 24 Neal Street, London, WC2H 9QW.

7.         Data Compliance (GDPR)
7.1            We hold and process personal data about you in order to send you the results of this initiative along with news, features and updates. 

7.2            This information is held on the legal basis of Consent. We will keep this information for three years, and periodically update and refresh our databases to ensure all contact information is still current and relevant.

7.3            Your information will be shared with our marketing and communications department who are administering this initiative.  

7.4            You have a number of rights with regards to how your data is protected. By providing us with your information you will have the right to access and rectify your personal details. If you did wish to access your data, you shall have the right to view or receive a copy of the information in a commonly used format such as a pdf document or an e-mail. Any information which is processed by automated means and is purely required for the performance of a contract, may be transmitted to another data controller if you request it. 

7.5            You may also have the right to ask for the processing of your personal data to be restricted or even erased. Whether or not you exercise the right to erasure, the Company will erase your personal data in certain situations and particularly when the data is no longer required.

7.6            Your data may be transferred and processed outside of the European Economic Area as some of the software providers we use are outside the EEA (e.g. our email servers, newsletter provider, CRM, cloud document storage are provided by companies incorporated in the United States of America)

7.7            Appropriate safeguards have been implemented which protect your rights in accordance with current data protection laws. This includes ensuring all platforms we and our suppliers and partners use are GDPR encrypted, are cloud-based and encrypt data where possible.

7.9            In the event that you should have a complaint about how your data has been processed by us, we would like to hear from you so that we may put it right. However, you will always have the right to lodge a complaint with the Information Commissioners Office.
